$5,010,000.00 Verdict in Nursing Negligence Case

August, 2006

On August 11, 2006, Feldman Shepherd attorneys, John M. Dodig, Esquire and Jason A. Daria, Esquire, obtained a $5,010,000.00 verdict on behalf of a fifty (50) year old Port Richmond woman who suffered permanent brachial plexus injuries to her right shoulder after falling from a hospital bed while hospitalized at the Hospital of the University of Pennsylvania.

Feldman Shepherd attorneys, Dodig and Daria, argued that the Hospital of the University of Pennsylvania nursing staff was negligent in leaving Diane Bugieda unattended in the upright position while in the Intensive Care Unit prior to her fall.

The jury awarded Diane Bugieda $1,000,000.00 for past pain and suffering and $3,000,000.00 for future pain and suffering. The jury also awarded $30,000.00 on an annual basis for medical care from 2006 through 2038, as well as an award of $50,000.00 to Diane Bugieda’s husband, Edward Bugieda, for loss of consortium.
